Converting to a Land Trust After Closing

  • I was talking to a friend in Chile who owns a farm there. He is a US citizen and also owns rental property in the United States.

    When he bought his properties in the US he usually took title in the name of his company or in his name if he was getting financing. He also got Title Insurance. After closing, he converted to a Land Trust. But he recently found out that the Title Insurance policy says, if you convert to a trust or other name after closing the Title Insurance is no longer valid unless you get written permission.

    Just making you aware of this. READ your title policy and follow the rules so you are protected.

    And if you use a quit claim deed to transfer the property, unless the title insurance is written on a broad form policy, you essentially destroy the title insurance as well.
